ILLINOIS DRUG CASE CHART
The following chart is provided only as a general educational guideline. It lists specific Illinois drug offenses, which
are based on two things: (1) the type of illegal drug seized; and (2) the weight of illegal drug seized. This chart
identifies the specific class for each offense and its corresponding sentencing range. (Please note, there are
aggravating factors that may enhance a defendant’s possible sentence beyond the listed sentencing range, such as;
proximity to a school, church, or other protected area; defendant’s criminal background; or factors that trigger other
statutes.)
UNDER NO CIRCUMSTANCES is this chart intended to encourage defendants to plead guilty to a drug offense. It is
simply an informational chart that answers some questions commonly asked by people who have been arrested for
committing a drug offense. For example; what is the maximum sentence I can receive if I am found guilty for this
crime? This chart will tell you.
This chart only provides information that includes the possible sentence a defendant can receive if he pleads guilty
or is found guilty of a drug offense. No defendant should ever plead guilty to committing a drug offense before
speaking to his attorney. An attorney may be able to improve the defendant’s pretrial position in a variety of ways,
for instance; (1) the attorney may be able to work out an agreement with the prosecutor that allows the defendant to
enter a diversionary program, such as drug school; (2) the attorney may be able to work out an agreement with the
prosecutor that allows the defendant to serve a sentence that does not involve prison time, such as supervision,
conditional discharge or probation; (3) the attorney may persuade the prosecutor to amend the charge to a lower
class offense; (4) the attorney may be able to suppress the drug evidence with a pretrial motion; (5) the attorney
may be able to have the charge dismissed with a pretrial motion; or (6) the attorney may be able to identify a
weakness in the State’s case that could be exploited at trial or before trial. There are many other ways an attorney
may be able to improve a defendant’s drug case or even beat a drug case.
