Weapon Charges for Felons or Unlicensed Users

In America we love our guns. I represent people who get into trouble because of their guns. Most weapon charges are for handguns, but a weapons charge can be for any firearm including rifles and shotguns and can also apply to knives, tasers and some martial arts implements.

Representing Clients Against Gun Charges

Although there are frequent efforts to create a conceal and carry law in Illinois, a law has not yet been passed. Most weapon charges are for unlawful use or possession of a concealed weapon.

You can be charged with a weapon charge if:

  • You possess a weapon and don't have a valid Firearm Owners ID (FOID) card
  • You transport a firearm in a car or truck that isn't unloaded, broken down, enclosed in a case or has a tricker lock.
  • You are a felon in possession of a weapon, or even ammo for a weapon
  • You possess an automatic weapon or another type of outlawed gun

Criminal Defense for Weapon Charges

As a Chicago criminal defense lawyer, I have had many occasions to defend felons and non-felons charged with weapon charges and violations. Here are few strategies that have worked in the past.

  • Do you feel you were you profiled? If there was not a good reason to stop you and search you, I can file a motion to suppress the evidence based on an illegal search and seizure.
  • Were there witnesses to the stop and search? A witness can help show that there was an illegal search.
  • Was it a "Terry stop?" A "Terry stop" is a stop based on the U.S. Supreme Court case of Terry v. Ohio. The ruling said that there must be "reasonable and articulable facts" to support the stop and it can't just be based on an officer's hunch.
